¿Quién va a ser el propietario del muro Trump?

En una orden ejecutiva emitida el día de ayer miércoles 25 de enero de 2017, el Presidente Donald Trump ordenó el inicio de la construcción de su kilométrica muralla Trump, con la advertencia repetida mil veces de que la construcción del muro sería pagada de un modo u otro por todos los mexicanos como nación.

Hay un detalle que me sigue causando asombro y en el cual ninguno de los más conocidos editorialistas y analistas y comentaristas de TV se han fijado hasta ahora. El detalle no es sobre la construcción del famoso muro, sino por el muro en sí, una vez terminado.

El Presidente Trump ha dicho que todos los mexicanos habremos de pagar por dicho muro, queramos o no. Supongamos que de alguna manera se sale con su propósito y logra sacarnos dinero de nuestros bolsillos para pagar por su muro costoso, ello nos conduce de manera inevitable a una interrogante fundamental: ¿Quién va a ser el propietario del muro?

Uno de los más elementales preceptos del comercio y del derecho internacional es aquél de acuerdo al cual quien paga por algo en su totalidad se convierte en el propietario exclusivo de aquello por lo que ha pagado con su propio dinero. Este derecho de propiedad incluye lo que se conoce como la máxima del jus utendi, jus fruendi, jus abutendi; o sea el derecho al uso, al goce y a la disposición de aquello sobre lo cual se es propietario. Donald Trump como el gran empresario que dice ser debe entender perfectamente bien esto, y si no entiende ni siquiera esto entonces sus capas neuronales están dañadas más allá de cualquier esperanza de posible recuperación.

Y si los mexicanos vamos a pagar por el muro en su totalidad, eso convierte no a los estadounidenses, no al gobierno federal, y mucho menos a su Presidente, en los propietarios legítimos del muro, sino a nosotros los mexicanos. Somo nosotros los que debemos tener pleno derecho al uso, al goce y a la disposición sobre lo que queremos que se haga con dicho muro. De hecho, como financiadores de la construcción del muro, tenemos pleno derecho a que el muro sea construído de acuerdo a nuestras especificaciones, con materiales proporcionados por empresas (mexicanas, desde luego) que sean seleccionadas después de una rigurosa licitación por nosotros mismos, y usando materiales previamente aprobados por nosotros, usando para ello mano de obra seleccionada por nosotros (puros mexicanos, desde luego, para darles empleo a algunos de los muchos que tiene planeado deportar Trump a México). Es lo menos que merecemos, si a nosotros se nos va a cobrar por ello. ¿O no?

Y si Donald Trump no quiere reconocer nuestro derecho legítimo a la propiedad y posesión de algo por lo que nosotros pagamos, entonces en cualquier país del mundo y bajo cualquier legislación desde los tiempos de Moisés y Hammurabi hasta los tiempos actuales ello se definiría como un robo, un atraco, y el que comete el atraco pasaría a ser un ratero, un asaltante, un malhechor, un pillo en toda la extensión de la palabra.

No sería la primera ocasión en la historia en la que el vecino país del norte nos arrebata algo que es nuestro. Ya en 1848 nos arrebató más de la mitad de nuestro territorio, un vil y canallesco atraco por el cual hasta la fecha ninguno de los gobiernos norteamericanos bajo ningún presidente ha pedido jamás disculpa alguna. Pero ahora ya en pleno siglo XXI, en pleno tercer milenio, uno supondría que los norteamericanos ya se civilizaron un poco y ya aprendieron su lección, algo indispensable para quien en numerosas ocasiones ha insistido en convertirse en policía del mundo entero. Pero por lo visto, con el nuevo gobernante Trump a la cabeza, los norteamericanos ya se están haciendo a la idea de que, por ser una potencia militar armada hasta los dientes con bombas atómicas, puede robarle a otros lo que no es suyo, puede quitarle a sus vecinos lo que es propiedad legítima de ellos por haberlo pagado de su dinero hasta el último centavo.

Y si aquello por lo cual se paga fué construído en territorio extranjero, sigue siendo propiedad legítima del que lo pagó, no del país que aloja la obra que fué construída. Razón por la cual una vez terminado el muro y una vez pagado por nosotros los mexicanos hasta el último centavo con dinero salido de nuestros propios bolsillos, podemos reclamar el muro como nuestro y hacer con el muro lo que nosotros queramos, ya sea hacer pintas en el muro, usarlo como barda para mantener fuera de territorio mexicano a los norteamericanos indeseables que sean drogadictos y violadores y criminales, o inclusive tirarlo si se nos pega la gana, porque es nuestro muro y no de los norteamericanos. ¿O no es así, Mister Businessman en la Casa Blanca?

Si el alucinado inquilino de la Casa Blanca insiste en llevar a cabo su canallesca acción reclamando su derecho de bully de que su país se quede con la posesión completa de un muro que nosotros los mexicanos vamos a pagar de cualquier modo hasta el último centavo, cometiendo contra nosotros un atraco en toda la extensión de la palabra, entonces más nos valdría irnos olvidando de que existe un país vecino al norte de México, e ir pensando en establecer alianzas con otros países o bloques de naciones como China o la Comunidad Europea. Al menos esos países y bloques de naciones están un poco más civilizados que los norteamericanos y están en una mayor disposición de respetar las normas del derecho y del comercio internacional. Por lo pronto, voy a desempolvar los viejos discos de Chino Mandarín que tenía desde muy chiquito con la finalidad de ir aprendiendo el idioma, porque a como van las cosas parece que pronto se ofrecerá estar familiarizado con la lengua de la que parece estar destinada a ser la próxima primera potencia mundial llenando el vacío que será dejado por los Estados Unidos tras su pérdida de liderazgo y su pérdida de credibilidad.

NYC stabbed by its most famous denizen

On Wednesday January 24th 2017, and via an executive order issued by the (illegitimate?) President of the United States of America, New York City ceased to be considered by the federal government as a sanctuary city for its tens of thousands undocumented immigrants who fuel the NYC economy. It stands out very prominently that NYC was stabbed in the back by a man whose center of operations as a businessman is precisely New York City and who was born in New York  City.

Donald Trump is going to end up frying New York City one way or the other; it is irrelevant what New Yorkers do or how they try to respond. There are only two possible courses (you might as well call them curses) of action: either abide by the executive order issued by Donald Trump and give up the status of being a sanctuary city, or resist the federal onslaught coming from Washington which from this point on can be considered an enemy of NYC.

In order for the executive order issued by President Trump yesterday to be effective in its intimidation of New Yorkers, federal funds to NYC cannot be cut by a mere one or two per cent, which would hurt somewhat but which would not cripple NYC. All federal funding must be cut by a full 100 per cent. That would really create some pain, and the hope of President Trump is that enough economic pain can be inflicted upon New Yorkers to force NYC to come to grips with its new reality and give up its status as a sanctuary city for undocumented immigrants, yielding to the power of a big stick being wielded by the American Caligula.

There is one major problem, though, in giving President Trump what he wants. If a massive roundup of undocumented immigrants begins in just a matter of days (and all indications are that the mass deportations are set to begin at any moment), New York City stands to lose overnight the important economic contributions that its undocumented immigrants represent. In the case of NYC, one thing that is almost certain to stand out is the fact that the claim of many immigrant hate groups that all of the undocumented aliens are Mexicans is a myth. NYC has distinguished itself by being a multi-cultural multi-ethnic society whose immigrants from all over the world, legal or undocumented, have made important contributions. There are many undocumented Irish living in the USA, especially in NYC, with an estimated 50,000 thousand. There are also many undocumented immigrants from Europe besides Ireland who are bracing anxiously at the thought of being entrapped by US marshalls and being deported together with their families back to Europe. Take Poland, for example. It is not well known that the Trump Tower was built by undocumented polish immigrants whom Trump abused. And in all likelihood Trump knew it all along before he became President! There are also undocumented immigrants from places as far away as Australia, New Zealand, even Russia! It is a baffling mystery of life that some small groups of immigrants gave their support to Donald Trump precisely in NYC. Where are they now that President Trump is coming out against all immigrants from all over the world who have contributed to the rich diversity of NYC?

Many of the undocumented immigrants in NYC from all over the world are living together with their families. They pay taxes. Some of them provide jobs. They help the Big Apple in keeping it alive with a rich diversity of contributions. It stands to reason that if Trump whose home city is New York itself gets his way, every single undocumented immigrant or families of undocumented immigrants will be deported back to wherever they came from, and in so doing it will most certainly deprive NYC from the cash flows those people represent. Although there are no exact figures on the economic damage that would be levied on NYC if it loses all of its undocumented workers of all nationalities to the whims and wishes of its former and most famous denizen, some estimates substantiate the belief that the damage that can be expected will be enormous. The permanent loss of all that labor force is likely to be a painful experience for NYC if it ever comes to pass, with no easy solutions or replacements in sight. In other parts of the country, especially in the agricultural industry, some have tried to replace the loss of undocumented workers after deportation roundups with labor provided by prison inmates, but that approach has failed so miserably that it is no longer considered as a viable option, certainly not a viable option for a city such as New York. It is no wonder that the Mayor of NYC, Bill de Blasio, has ruled out the possibility of joining President Trump in his aggressive nazi-style deportation roundups by refusing to let NYC give up its status as a sanctuary city, and he is not alone in taking this position. Other Mayors have also concluded that, although giving up the income that all the federal programs represent may sound like a crazy idea, losing overnight all of the undocumented labor force that their cities need to keep their cities operational and functioning is even crazier.

NYC is not the only city that is being threatened by a total cut of federal funds in case it refuses to give up its status as a sanctuary cities. There are other cities as well such as San Francisco and Los Angeles that are in the cross hairs of the lunatic-turned politician-turned President Donald Trump. But the case of NYC is very special not just because NYC depends quite a bit on its undocumented workers to sustain its economic well being, but also because it has been the hometown of the same man who now threatens to strangle precisely the very city in which he was born, showing a lack of respect and gratitude for his hometown. But then, what else can be expected from a man without a soul who is guided not by a steady bright man but by his primeval impulses?

As for all those who wish to see a permanent solution to the anguishing dilemma posed against NYC by its most famous denizen, indeed there was a solution. But that solution was in the hands of the people for just one day, on November 8th, 2016, the day the presidential elections were held. Sadly, that day has come and gone. There is no way out now, except for the solution destiny itself may provide. For the time being, New  Yorkers should brace themselves for what will most likely be hard times, and not just NYC but the entire country and even the entire world. Such is the impact that can be expected in the coming months and in the coming years, for what will be at a minimum four painful years from a self-appointed Messiah who is already wreaking havoc and running amok, drunk with the poison of absolute power, just as was anticipated here in this blog nearly ten months ago.

A wrong kind of unity

Shortly after it became known that Donald Trump had won the presidential election in spite of having lost the popular vote by 3 millions votes, almost immediately there were calls for a “healing process” to start, no doubt prompted by the fact that US society was left as a seriously divided nation.

After the defeat of Hillary Clinton, both her and Barack Obama made calls for unity. Hillary called for a “peaceful transition of power”, urging: “We don’t just respect that. We cherish it. It also enshrines the rule of law; the principle we are all equal in rights and dignity; freedom of worship and expression. We respect and cherish these values, too, and we must defend them. We have seen that our nation is more deeply divided than we thought but I sill believe in America and if you do then we must accept this result,” she added in an emotional concession speech. “We owe him an open mind and the chance to lead.”

Likewise, House Speaker Paul Ryan called for unity following the election of Donald Trump, saying the Republican nominee “just earned a mandate” and adding: “Donald Trump will lead a unified Republican government,” Ryan said, noting that he believed Trump heard the voices of those who felt they were no longer being listened to. “This is the kind of unified Republican government that we set out to deliver. We all need to reeducate ourselves to making America great,” he added, echoing Donald Trump’s campaign slogan.

Trump himself on his victory speech that was delivered Wednesday November 8th 2016, one day after the election results became known, a victory stated that “Now it is time for Americans to bind the wounds of division. It is time for us to become together as one united people”.

Similar calls to unity were made throughout the USA, understood as calls to unity around Donald Trump as president of the USA.

There is just one catch to the unity that Donald Trump is asking from every single American.

The kind of unity that Trump is talking about is unity around him and the aggressive philosophy and ideology he displayed throughout his campaign. We all know what he stands for, and this applies equally well to those who are against him as those who are his unconditional followers and supporters. And if all the American people unite 100 per cent around him as Trump wants, embracing his radical agenda, this would bode ill for the future of the USA as a country.

It is not the first time in history that a prominent or even a controversial figure has asked the people of his country to unite around him and support him in all his actions. History has plenty of examples. Winston Churchill did so when he told his people with World War Two underway: “I have nothing to offer but blood, toil, tears and sweat”. The people knew exactly the kind of sacrifices Prime Minister Churchill was asking from them, and the Brits united around him wholeheartedly throughout the war until victory was achieved at great cost and sacrifice.

But Donald Trump is no Winston Churchill, quite the contrary, perhaps he represents some of the more disgusting traits that can be expected from a leader.

When Adolf Hitler rose to power, there was a call to all Germans to set aside their differences and unite as one around the leadership of Hitler, which of course meant abiding and even condoning his plan of action. The call for unity was answered, but after what amounted to nothing less than a major catastrophe, it became clear that there should have been a stronger opposition in Germany during the thirties in order to act as a checks and balances against the abuse of power that would soon be displayed. In the end, since there were no checks and balances and thus no separation of powers, an entire generation had to pay a very heavy historical price for such “unity”.

Remember the Soviet Union? All soviets were expected to show unity around the cruel and brutal dictator Josef Stalin. Those not willing to unite around Stalin and show their unity with patriotic fervor were considered traitors. As a matter of fact, that is precisely the reason of why the Soviet Secret Police or KGB was created, to seek out and destroy all those traitors not willing to unite unconditionally around Stalin. The end result was a cult of personality intensified by a massive expenditure in official propaganda designed to place Stalin in the niche of a demi-god. Stalin ruled with an iron fist, hundreds of thousands were murdered without a trial under his orders, yet he was supposed to be the symbol of unity of all those ruled behind the Iron Curtain. Only when the Soviet Union crumbled and fell apart was the unity proved to be a farce, nothing more than a façade that hid gruesome state sponsored against the very same people whose unwavering loyalty was expected at all times.

Closer to home, we can learn something from the legacy left by Hugo Chavez, who as President of Venezuela enjoyed the boom of high oil prices and squandered away the incoming wealth coming from overseas in his socialistic program, commanding the unconditional unity and loyalty of many of his followers. But the oil bonanza went from boom to bust, and his hand-picked successor has established a de-facto dictatorship and has carried Venezuela toward the brink of a social and economic catastrophe. That’s what Venezuelans of today reaped from all the unconditional loyalty and unity they gave Hugo Chavez. And it might be added that Hugo Chavez did not seize power by a coup, he was elected President of Venezuela in 1998 in democratically free elections. And just like in the U.S. in 2016, Chávez’s promises of widespread social and economic reforms won the trust and favor of the primarily poor and working class. By May 1998, Chávez’s support had risen to 30% in polls, and by August he was registering 39%. All that is history, and Venezuela is suffering severe economic hardship, and what’s worse, they don’t have even the faintest idea on how they will be able to pull their country out of the hole, assuming that somehow they can get rid of Nicolas Maduro, the successor of Hugo Chavez.

Those who are followers of Judaeo-Christian spiritual literature should recall that Satan himself also wanted unity in Heaven from all the other angels, but this meant unity around him, around Satan. Clearly, this could not be so, and eventually those angels who did unite around Satan and joined in an open rebellion ended up paying a very heavy price, they all ended up in Hell at the hands of a very angry and defiant angel who has never showed any compassion or mercy to anyone.

So, should Americans heed all the calls to unite and support as one nation the 45th president of the United States, Donald Trump? Considering that he lost the general vote and was beneficiary of a crooked electoral system that can give the presidency to someone who does not win by a majority vote, and also considering his fierce racist and populist rhetoric that places him at a par with Adolf Hitler himself, joining Trump and what he stands for could very well be a recipe for disaster.

But shouldn’t Americans consider the risk of the country coming apart in case they do not unite blindly around the 45th president, Donald Trump? Well, back in Germany 1945 the country became split anyway, splitting into East Germany and West Germany, and this was not even a decision left to the German peoples themselves, it was a splitting imposed upon Germany by the Allies who defeated Nazi Germany.

One of the charms of democracy is that it guarantees a peaceful transition of power. The only kind of unity worthy of consideration is around the tradition that offers an alternative to bloody coups and violent toppling of regimes that can only be ousted by no other means. But that’s as far as it has to go. With regards to embracing the entire agenda of a lunatic, that’s something else, no blank check should be given here, no unconditional support should be granted to things that in the long run will almost certainly bring irreparable damage. If those who ask the American people to gather around Donald Trump and unite with him are really calling for uniting around a loose cannon, that’s the wrong kind of unity.

By now it should be evident that Donald Trump will not engage in any moral considerations in taking his decisions. He is precisely what the great Athenian historian and general Thucydides defined as an immoral leader, a person of violent character who charms men by lying to them and deceiving them, exploiting their fears and rages. Graydon Carter, editor of Vanity Fair magazine, wrote an article entitled Only In America. The article begins with the line: “Only in America could a man whose staff took away his Twitter account be given the nuclear codes”, adding “Only in America could a man who kept a volume of Hitler’s speeches by his bedside rule over the second-largest Jewish population in the world”.

The throngs of women who marched on January 21 2017 at the 2017 Women’s March that gathered at least half a million participants, with the support of hundreds of marches on the same day throughout the U.S. and other countries to the tune of 673 marches worldwide, with 20 in Mexico and 29 in Canada, have already made it clear that they will not unite blindly around a man who has spoken in no ambiguous terms of what he thinks of women as a whole and whose disrespect towards women is by now something impossible to hide. They have already made it clear that they will not be stooges of a man who has been branded by noted Mexican historian Enrique Krauze as being “A sociopath drunk on himself. His religion is hatred. His god is Donald Trump. He is also addicted to empty adjectives. He is not a man of his word or of words as markers of truth”, and who is convinced that Trump is a bully, a megalomaniac, a narcissist and even paranoid -much like the Fuhrer who saw enemies everywhere- craving for attention and not only 15 minutes of fame, willing to do anything to remain in the spotlight. There are many negative descriptions of Donald Trump that can be easily found throughout the net, I will not bother to reproduce them here. As a matter of fact, he may be by now one of the most reviled world leaders in U.S. history, and he has barely started to implement his crazy agenda!

In the 2001 American science fiction film Rise of the Planet of the Apes, the turning point comes about when the ape Caesar yells NO! In the 2017 event of life imitating art, the 2017 Women’s March has already made it clear that many women in America will not stand by idly while the new American autocrat tears apart all of the women’s rights that women fought for so hard for decades. Many American women have united by yelling NO! But what about the other millions of women who gave Donald Trump their vote and who still support  him? Won’t they shield the freshly inaugurated autocrat from attacks coming from the other side? Perhaps. But as soon as those women begin to feel the heat and begin to suffer the dire consequences of the Trump presidency, it is very likely that sooner or later they will start changing their minds making it ever so difficult for the loose cannon in the White House to do his whim with no opposition.

This fight has barely started. Rejecting all those calls to unity that imply American unity around the sociophatic agenda of Donald Trump is a must, for that is the wrong kind of unity that can only carry the entire USA towards its doom. He has already started off with the lowest approval rating for any President in US history. But governmental agendas and policies are not set by opinion polls, and it is a given that Donald Trump really does not care a bit about his approval ratings. What can really worry him is the possibility that in the next elections that will take place for the renewal of Congress, the Republicans may end up losing the comfortable control they now have over both Houses of Congress. The big liar whose now cabinet members promised he would release his tax returns to the American public and so far hasn’t kept his word believes he will be able to dupe again the American people by resorting to the same antics and campaign-by-twitter that put him in the presidency in the first place. But if so, he misses out one very important point: the coming months and years there will be what we might call a learning curve, perhaps a very painful one, where the utopia he promised may very well end up being a dystopia, and during the painful trek it is possible that many of those who now follow him blindly will begin to jump off the bandwagon. The only true danger is that, if he feels he is being left alone, his persecutory delusions may end up catching up on him, and he could take some wild and spectacular decision to make his indelible mark in history but at the cost of carrying the entire nation down the drain with him. Indeed, is is all about a race against the clock. As to who wins and who loses, we cannot foresee such things, but eventually they will become known.

The March held on Saturday January 22 2017 was a good start, the right start, in order to show the beast at the White House that those who oppose him will not remain silent, and that they are willing to put up a fight, after considering that uniting around Trump equals the embracement of his xenophobic, racist, misogynist and ultraconservative extreme right wing philosophy. And when re-election times come for Congressmen and Senators, it will be the proper occasions to review their credentials and cast a vote either for them or against them, depending on who they chose to represent, either the madman at the White House, or the American people. And remove from office if need be all those who took sides against the American people.

Duro golpe de México a cubanos de Miami

Desde hace años, el gobierno de México había mostrado una actitud generosa hacia todos los cubanos que cruzaban el territorio mexicano usando a México como trampolín para llegar a la frontera con Estados Unidos, cruzando a pie la frontera a través de alguno de los puentes internacionales sin ningún problema para ser recibidos y admitidos de inmediato con los brazos abiertos por las autoridades migratorias norteamericanas y obtener así casi de inmediato su residencia permanente en los Estados Unidos sin necesidad alguna de tener que hacer aplicación de solicitud de inmigración legal ante ningún consulado o embajada pasando a una engorrosa y burocrática lista de espera en la que a muchos les toca su turno después de unos diez años, sin necesidad de tener que cumplir con ninguna escolaridad mínima, sin necesidad de tener que someterse a exámenes médicos y tener que aprobar esos exámenes médicos, sin necesidad de nada, todos estos privilegios gracias a la política de “Pies secos, pies mojados” que estaba en vigor en Estados Unidos desde los tiempos en los que Bill Clinton era presidente de Estados Unidos.

La política discriminatoria de “Pies secos, pies mojados”, en el sentido en que era no discriminatoria en contra de los cubanos sino en contra de todos los demás inmigrantes a USA tanto legales como indocumentados de todos los demás países del mundo, terminó hace poco cuando el 12 de enero el presidente Barack Obama le dió fin a esta política que le daba un trato migratorio preferencial a los cubanos nativos de Cuba por sobre todos los demás aspirantes a inmigrar legalmente a los Estados Unidos. Los cubanos eran los únicos beneficiarios por este trato discriminatorio hacia todos los demás países del mundo.

Casi como una nota perdida, pero de enorme importancia y trascendencia sobre todo para los cubanos que residen en Miami y que están a la espera de familiares que ahora residen en Cuba pero que ansían reunirse con ellos, es la que trata de una secuela en México que el fin de la política de “Pies secos, pies mojados” trajo consigo. La nota está perdida entre otras notas periodísticas de mayor envergadura como la investidura oficial de Donald Trump como presidente de los Estados Unidos y la extradición de Joaquín Guzmán Loera “El Chapo”, pero solo es cuestión de tiempo para que la nota comience a resonar en forma estruendosa entre la comunidad cubana de Miami.

La nota en cuestión fue dada este sábado 21 de enero de 2017 por la agencia noticiosa AFP bajo el título “Deportan a 91 cubanos varados”, y dice que México repatrió el viernes 20 de enero (ayer, precisamente el mismo día en el que Donald Trump tomó posesión de la presidencia de Estados Unidos) a 91 cubanos indocumentados que buscaban llegar a Estados Unidos, según informó el Instituto Nacional de Migración (INM) de México, una semana después de que el aún presidente Obama modificara las políticas que favorecían el ingreso de los isleños cubanos a territorio norteamericano. Se trata de 71 varones y 20 mujeres cubanos, que habían llegado a Chiapas, en la frontera con Guatemala, los cuales buscaban obtener en México “un oficio de salida, que les permitiera transitar libremente por territorio mexicano para llegar a los Estados Unidos”, una medida que se otorga a extranjeros no reconocidos por consulados de sus países. En rigor de verdad, es bien conocido entre los cubanos desesperados por inmigrar a los Estados Unidos que una vez pisando suelo mexicano las cosas se les facilitan enormemente, ya que no solo hay albergues caritativos en los que se les dá apoyo, alojamiento y comida a los migrantes de otros países en tránsito hacia los Estados Unidos, sino que podían viajar todavía hasta hace poco y sin mayores problemas desde Chiapas hasta la frontera con Estados Unidos en donde todo lo que tenían que hacer era cruzar la línea divisoria para que, en vez de ser baleados por agentes de la Border Patrol como ocurre con los indocumentados mexicanos, la recepción que tenían gracias a la política de “Pies secos, pies mojados” era inmediata y cordial. En efecto, lo difícil para esos cubanos era llegar a México, pero ya una vez en territorio mexicano podían dar por hecho que la travesía había terminado, y el ingreso por la frontera a los Estados Unidos era un mero trámite. Pero eso ya se acabó.

No es la primera vez que hay una deportación de cubanos de regreso de México a su país de origen. El Instituto Nacional de Migración deportó el viernes 12 de agosto de 2016 a 88 migrantes de Cuba, a quienes trasladó en un avión fletado desde el aeropuerto de Tapachula, Chiapas. La expulsión, que el INM llamó “retorno asistido”, ocurrió después que la embajada de la isla los reconoció como ciudadanos de su país. De los trasladados 72 eran hombres y 16 mujeres. Los migrantes se habían entregado al gobierno mexicano para solicitar un oficio de salida, que les permitiría cruzar el país hasta la frontera con Estados Unidos según denunció la organización Movimiento Migrante Mesoamericano. Hasta abril de 2016 el gobierno mexicano había entregado este documento –que funcionaba como salvoconducto para evitar la deportación- pero a partir de agosto de 2016 empezó a negar el trámite.

La deportación que ocurrió el 12 de agosto de 2016 fue la primera deportación de ciudadanos cubanos desde que en mayo de 2016 entró en vigor el Memorándum de entendimiento en materia migratoria, firmado en noviembre de 2015 durante la visita de Estado del presidente Enrique Peña Nieto a Cuba. El Memorándum fue una enmienda a un acuerdo migratorio anterior establecido en los años 80, y que básicamente estableció protocolos y reglas para la deportación de migrantes irregulares hacia la isla. Durante décadas el documento se mantuvo virtualmente sin aplicación, pues los distintos gobiernos del Partido Revolucionario Institucional (PRI) por lo general no devolvían a los cubanos a su país. Cuba tampoco los reclamaba. El tema formaba parte de un acuerdo no escrito de “dejar hacer, dejar pasar” en materia migratoria, y que básicamente consistía en que México permitía el libre tránsito de su territorio a casi todas las personas en viaje a Estados Unidos. Se trata de una costumbre que se mantuvo incluso durante las administraciones del Partido Acción Nacional (PAN), cuando las relaciones diplomáticas entre ambos países se congelaron. La historia cambió en 2014 cuando Barack Obama, el presidente de Estados Unidos, declaró que existía una crisis humanitaria por la llegada de unos 60.000 niños y adolescentes centroamericanos a su país. El gobierno del mexicano Enrique Peña Nieto estableció el Plan Frontera Sur para contener el flujo de extranjeros en la frontera con Guatemala. Y un año después actualizó el acuerdo migratorio con Cuba.

No está claro quiénes fueron los primeros cubanos deportados por México ese 12 de agosto de 2016, ni tampoco el tiempo que habían permanecido en el país. El INM no informó el sitio donde permanecieron durante el período en que la embajada cubana hizo el reconocimiento de ciudadanía. El Movimiento Migrante Mesoamericano asegura que en la deportación participaron las policías Federal y la de Chiapas, así como agentes del Grupo Beta. El objetivo fue “controlar las acciones de protesta e inconformidad de los cubanos”, señala la organización civil. Los ciudadanos expulsados esperaban recibir el mismo trato de otros 4.000 connacionales suyos al inicio de 2016, quienes se habían quedado varados en la frontera entre Costa Rica y Nicaragua. Los migrantes abandonaron la isla después que La Habana y Washington normalizaron sus relaciones, suspendidas desde 1959.

Miles abandonaron Cuba tras el deshielo diplomático iniciado por Barack Obama. La mayoría viajó a Ecuador –que en ese entonces no les solicitaba visa- y de allí siguieron camino hacia el norte hasta que Nicaragua les cerró la frontera, en diciembre de 2015. Un acuerdo regional les permitió seguir el viaje a través de un puente aéreo desde Centroamérica a México, que les entregó a todos una orden para abandonar el país antes de 25 días el cual les permitió entregarse a las autoridades migratorias de Estados Unidos. Pero eso es historia. La deportación de los 88 cubanos desde Tapachula es el crudo despertar del sueño cubano.

Lo duro para esos 91 cubanos que ya se encontraban en México radica en que todos ellos fueron deportados por avión de regreso a Cuba en vez de recibir un permiso temporal del gobierno mexicano para permanecer en México mientras se resolvía el asunto de su situación migratoria bajo la esperanza de que Donald Trump como nuevo presidente pudiera revertir la orden ejecutiva de Obama resinstaurando la política de “Pies secos, pies mojados”. Este tipo de permiso temporal se les podría haber dado sin problema alguno. Pero no se les dió, y bajo el argumento de que todos ellos se encontraban “administrativamente irregulares en territorio mexicano”, todos ellos fueron regresados directamente a Cuba en un avión oficial, tras obtenerse el permiso de Cuba para que la aeronave aterrizara en La Habana.

El impacto de la noticia no fue solo para esos 91 cubanos, posiblemente la mayoría de ellos con familiares en Miami que ya los estaban esperando, que fueron deportados desde México. La decisión del gobierno de México, constituyendo en efecto la adopción de una nueva política en relación a los cubanos aspirantes a inmigrar a Estados Unidos utilizando el territorio mexicano como trampolín, sorprendió a miles de cubanos en varios países de América Latina en tránsito hacia Estados Unidos, y los dejó en un limbo. El mensaje es perfectamente claro: cualquier cubano que sea encontrado en territorio mexicano sin un pasaporte y sin una visa consular expedida legalmente en Cuba, será deportado en avión en vuelo directo de regreso a Cuba, y aunque tenga familiares cubanos en Miami eso ya no le servirá absolutamente de nada.

¿Por qué el endurecimiento en la actitud del gobierno de México, afectando especialmente la reunificación de cubanos con sus familiares en Miami? Esto tiene que ver directamente con el hecho de que cubanos de Miami estuvieron apoyando a Donald Trump para lograr su triunfo en la Florida, estado que en caso de haberlo perdido le hubiera vuelto imposible el poder obtener un triunfo en la carrera presidencial. Puesto de otra manera, el que el antimexicano Donald Trump sea hoy presidente de Estados Unidos se debe en buena medida al apoyo que le dieron muchos cubanos de Miami, dándole la espalda a sus hermanos latinoamericanos y clavándole un puñal en la espalda a los mexicanos, a sabiendas de todas las amenazas que Trump ha proferido en contra de México. Esta fue la gota proverbial que derramó el vaso.

La actitud del cubano de Miami hacia el mexicano en su mayor parte ha sido una actitud de desprecio, de soberbia, incluso altanera, presumiendo cierto aire de superioridad que ahora por primera vez en décadas se está desinflando.

¿Esperaban realmente los cubanos de Miami con familiares en tránsito hacia los Estados Unidos que el pueblo de México les continuara dando la amistad que antes siempre les había dado, cuando gracias a ellos el peor enemigo de México logró ganar el estado de Florida sin el cual Trump jamás habría podido llegar a la presidencia? Hoy los cubanos de Miami están cosechando lo que sembraron, y el resentimiento es enorme.

Es posible que Donald Trump revierta la orden ejecutiva dada por Barack Obama que le puso fin a la política de “Pies secos, pies mojados”. Pero no es tan fácil dar ese paso, ya que si Trump lo hace inevitablemente tendrá costos políticos para él. Por naturaleza, Trump es racista, xenófobo, y ciertamente es un anti inmigrante hasta la médula de los huesos. Restablecer la política de “Pies secos, pies mojados” es algo que va directamente en contra de la naturaleza anti inmigrante de Trump. Por otro lado, de acuerdo con una encuesta dada a conocer por Univisión, una gran mayoría de los encuestados aprueba que se le haya dado fin a la política de “Pies secos, pies mojados”. Trump ya dijo que su primera prioridad será darle empleos bien pagados a los norteamericanos. Obviamente, no es posible que pueda cumplir su promesa si continúa admitiendo a decenas o centenas de miles de migrantes que en su mayoría carecen de estudios universitarios y que estarán compitiendo en contra de los mismos trabajadores norteamericanos por una cantidad cada vez más escasa de empleos.

En caso de revertir la política de “Pies secos, pies mojados”, las mismas organizaciones xenófobas a las cuales Donald Trump les debe también en buena medida su triunfo, como la Federation for American Immigration Reform, pegarían el grito en el cielo y entrarían en franca rebeldía, y considerando que Trump empezó su presidencia con bastantes manifestaciones de protesta en su contra, es dudoso que quiera echarse encima y en contra suya a los suyos propios. Sí, es cierto que Trump le debe mucho a los cubanos de Miami, pero también tiene facturas políticas que tienen que ser pagadas y compromisos con otros grupos de raigambre proteccionista y anti-migratoria a los cuales les tiene que rendir cuentas y que en caso de fallarles se lo pueden recordar en la reelección correspondiente a la carrera presidencial de 2010. No es tan fácil.

En el supuesto de que Trump, presionado por las circunstancias y por consejeros suyos como el racista Stephen Bannon y el procurador general Jeff Sessions que es abiertamente anti inmigrante y racista en contra de todos los latinos, decida dejar en pie la eliminación de la política de “Pies secos, pies mojados”, si con todo esto aún queda algún cubano por allí que quiera aventurarse a cruzar por territorio mexicano, a sabiendas de que en caso de ser detectado en México por las autoridades será deportado en vuelo directo de regreso a Cuba, se topará con otro problema: la construcción del gran muro fronterizo con el que Trump quiere hacer imposible el ingreso ilegal de cualquier indocumentado, incluído el indocumentado que haya salido de Cuba.

A menos de que ocurra un milagro, es posible que pronto, muy pronto, los cubanos indocumentados de Miami que se puedan producir empezarán a sufrir las mismas angustias, el mismo dolor, la misma agonía, que la que enfrentan millones de indocumentados mexicanos. Y si tal cosa llega a ocurrir, el inmigrante cubano en Estados Unidos ya no será ni mejor ni peor que cualquier inmigrante mexicano en Estados Unidos, ambos serán iguales ante la ley, en lo que toca a la dureza que se le aplicará a ambos grupos. Todo para terminar enfrentando por igual las mismas cacerías de indocumentados ordenadas por el gobierno más racista y xenófobo que se haya dado en toda la historia de la Unión Americana. Es hora de que el total de los cubanos de Miami se pongan a pensar de que en esta ocasión, y aunque fuese por esta única ocasión, se le deberían de haber unido a los latinos e hispanos en la lucha que se llevó a cabo para impedir que Donald Trump pudiera convertirse en la pesadilla que hoy se está volviendo realidad en suelo americano. Hoy ya es demasiado tarde para ello.

Post Data: El miercoles 25 de enero de 2017, precisamente el mismo día en el que Donald Trump emitió ya como presidente de los Estados Unidos una orden ejecutiva ordenando la construcción de un gigantesco muro fronterizo con México, el gobierno de México deportó a 69 cubanos regresándolos directamente a la isla de Cuba. El mensaje del gobierno de México es clarísimo: todos aquellos cubanos que residen en Miami y que están alentando a sus familiares que residen en la isla de Cuba a viajar por territorio mexicano para tratar de ingresar a territorio norteamericano, deben avisarle cuanto antes a sus familiares que ni siquiera intenten hacerlo, porque en caso de ser capturados en territorio mexicano van a terminar siendo deportados en vuelo directo de regreso a la isla de Cuba, y todo el dinero que les hayan enviado sus familiares en Miami para hacer el viaje desde algún país de centroamérica o de sudamérica será dinero tirado a la calle, todo ese dinero se perderá y sus familiares se encontrarán de regreso en Cuba sin un solo centavo.

Hay miles de cubanos varados en países como Costa Rica, y viendo el trato que se les está dando en México a todos los cubanos isleños que están llegando a M éxico en calidad de indocumentados, les sale mucho más barato y menos riesgoso regresar en avión a Cuba y desde Cuba usar otro medio que no sea México, por ejemplo viajando hacia Canadá, para desde allí tratar de internarse en territorio norteamericano. La ruta a través de México hacia los Estados Unidos para la migración cubana indocumentada puede considerarse oficialmente muerta, sobre todo a los cubanos de Miami que tengan familiares en la isla de Cuba y que votaron por Trump para darle el estado de Florida y el triunfo a Trump el enemigo declarado de México. Si los cubanos de Miami tienen algún motivo de queja, que no se vengan a quejar a México, que se vayan a quejar a Washington directamente con Trump.

Tan solo aprovecho la ocasión para pedirles a los cubanos en Miami que no anden pidiendo solidaridad ni comprensión al pueblo mexicano para ayudarles a llevarse consigo a sus familiares que residen en Cuba permitiéndoles su estancia ilimitada en México mientras tratan de ingresar a pie a territorio norteamericano. Ellos, los cubanos de Miami, no mostraron ninguna solidaridad ni comprensión con los mexicanos a la hora de que se decidiera quien iba a ser el próximo presidente de la Unión Americana, y ayudaron a ganar al que ya había dejado sentir su odio feroz en contra de todos los mexicanos. Vayan pues los cubanos de Miami desde Miami hasta Washington para pedirle solidaridad y comprensión a ese barbaján. Y se les recuerda que como la ruta de inmigración cubana hacia Estados Unidos a través de México ya ha sido cerrada, la única manera que tendrán sus familiares en la isla de Cuba para hacerlo será viajando primero hasta Canadá sin pasar por México, o bien en vuelo directo desde Cuba hacia los Estados Unidos, aunque para esto último supongo que se requiere primero que nada que haya unas relaciones diplomáticas excelentes entre el gobierno de Washington y el gobierno de Cuba, pero se advierte que el actual inquilino de la Casa Blanca ya ha dejado ver su odio y animadversión hacia el actual régimen cubano, por lo cual se antoja poco probable que los cubanos de Miami podrán sacar de la isla de Cuba a sus familiares posiblemente por mucho tiempo.

Para colmo de males (para los cubanos de Miami con familiares en la isla de Cuba), no será un gringo anglosajón racista ni un mexicano quien le pondrá la horca en el pescuezo a los inmigrantes cubanos que en calidad de indocumentados puedan llegar hasta Miami para reunirse con sus familiares que residen en Florida. Será ni más ni menos un cubano nacido en la isla de Cuba en 1954, Carlos A. Giménez, el alcalde del condado Miami-Dade, el cual ya renegó por completo de sus raíces cubanas y ha declarado que se unirá a Trump en la cacería de indocumentados (esto incluye ahora a los indocumentados cubanos) al tomar la decisión de que bajo su mandato Miami ya no será una ciudad santuario, actitud que dicho sea de paso confirma el hecho innegable de que el híbrido cubano-americano es un ser de ficción que no existe como ya se dijo aquí, ya que a la postre se puede ser cubano o se puede ser norteamericano como lo es el caso de Carlos A. Giménez, pero es imposible ser ambas cosas porque simple y sencillamente va contra natura. Y si los cubanos llegados de Cuba que ya le juraron amor y lealtad a la bandera norteamericana arrodillándose e hincándose ante ella para terminar repudiando el país de origen de sus ancestros no tienen el menor interés ni la menor intención de ayudar a los suyos propios, los cubanos isleños, ¿por qué razón habría de mostrarles mayor afecto México?

El pueblo unido, jamás será vencido

Hoy ocurrió algo de lo cual no tengo memoria de nada parecido ni recuerdo que haya sucedido alguna vez antes en la historia de México.

Después de haberse aprobado casi a escondidas por un Congreso estatal de mayoría panista  el pasado 30 de diciembre de 2016 (casi al estar por terminar el año 2016) una Ley de Agua con la cual muchos ciudadanos de Baja California consideraron que se privatizaba el servicio público del agua potable, tomado generalmente como el preludio de un aumento esperado a las tarifas del agua potable, el gobernador panista de Baja California, Francisco Vega de Lamadrid, anunció la derogación de dicha Ley del Agua. O sea que la odiada ley no estuvo vigente ni siquiera tres semanas cuando el gobierno de Baja California se vió forzado por las circunstancias, obligado por el pueblo literalmente hablando, a dar marcha atrás.

La derogación de la Ley de Agua mediante una iniciativa enviada por el gobernador Francisco Vega de Lamadrid dándole marcha atrás a tan repudiada ley sucedió después de una manifestación masiva en Mexicali efectuada el domingo 15 de enero en la que participaron 45 mil ciudadanos en contra de la nueva ley y en contra del aumento pretendido con dicha ley. Se trata de un reclamo social al cual se sumó incluso la CANACINTRA.

Esto es algo completamente inédito en México, el que se dé marcha atrás y de manera tan rápida a una ley recién aprobada. Ni siquiera el presidente Enrique Peña Nieto, pese a las numerosas protestas que han cundido en todo el país en contra del megagasolinazo, algunas de ellas violentas con saqueos a tiendas y comercios, ha cedido un solo ápice, y por el contrario se ha aferrado a mantener la vigencia del megagasolinazo cueste lo que cueste, reafirmando que no importa la popularidad y que está dispuesto a asumir los costos políticos de sus cada vez más impopulares decisiones.

¿Qué nos demuestra lo sucedido? Que si el pueblo sale unido para presentar un frente de lucha bastante amplio, la fuerza del pueblo puede cimbrar a quienes dicen ser sus representantes populares, al grado de obligarlos a tener que dar marcha atrás hasta a leyes ya aprobadas y a punto de entrar en vigor.

El pueblo unido, jamás será vencido. Esta es la lección histórica del duro revés que sufrieron tanto el gobernador de Baja California como el congreso estatal de mayoría panista, y debe servir como pauta para otras cosas de enorme interés social en las cuales los gobiernos locales se rehusan a dar marcha atrás hasta que vean que ya no es posible mantener sellada la tapa de la caldera de presión que está a punto de estallar.

En Chihuahua, y en especial en Ciudad Juárez, en el año de 1983 se llevaron a cabo protestas y manifestaciones masivas que prácticamente obligaron al gobierno federal a introducir cambios importantes en las leyes que permitieran a la larga irle abriendo paso a la democracia que tenemos hoy los mexicanos, una democracia todavía imperfecta que sigue requiriendo de la participación de la ciudadanía para llevar a cabo las últimas purgas de gobernantes y partidos, pero mucho mejor que el gobierno autócrata de partido únicos que estuvo gobernando a México por siete décadas bajo las siglas de un mismo partido político.

Tres décadas después, en Chihuahua se está dando un aumento en las tarifas del agua potable. Pero aquí no se está dando marcha atrás a estos aumentos. ¿Por qué? Pues porque en Chihuahua, y sobre todo en Ciudad Juárez, en donde antes se juntaban decenas millares de personas para protestar en contra de cosas como el fraude electoral, ya no se juntan esas multitudes, a diferencia de lo que sucedió en Mexicali. En donde el pueblo se mantenga unido los gobernantes cederán en los abusos que quieran cometer en sus actos de gobierno, pero en donde el pueblo esté desunido los abusos se cometerán con toda impunidad como lo demuestra lo que ocurrió en Veracruz durante el tiempo que fue gobernado por Javier Duarte que hoy se encuentra prófugo gozando de una fortuna ilegal estimada en miles de millones de pesos.

¿Fin en USA de ventaja migratoria para cubanos?

El jueves 12 de enero pasado el Presidente Barack Obama mediante una orden ejecutiva puso fin a la política migratoria norteamericana conocida como Pies secos, pies mojados, bajo la cual cualquier cubano que pusiera su pie en suelo norteamericano, ya fuese en la costa estadounidense o en algún otro lado (como en la frontera México-Estados Unidos), con el solo hecho de hacer tal cosa, y sin necesidad de tener que cumplir ninguno de los requisitos mínimos que cualquier otro inmigrante legal a los Estados Unidos está obligado a cumplir como el tener que proporcionar certificados de escolaridad, carecer por completo de antecedentes penales, pasar un examen de salud con análisis clínicos llevados a cabo en un laboratorio aprobado por un Consulado o una Embajada norteamericana, y sobre todo, esperar pacientemente el turno por varios años en la cola de espera que se forma para dar entrada a Estados Unidos bajo un sistema migratorio con un número anual muy limitado de visas sumado a una categoría de preferencias que vuelven muy difícil poder inmigrar legalmente a los Estados Unidos a cualquier otro habitante de cualquier otro país del mundo. Bastaba con poner pie en suelo norteamericano para tener derecho legal pleno a ser recibido en Estados Unidos y a recibir un pasaporte de residencia norteamericano en tan solo un año. En efecto, el inmigrante cubano recibía trato de primera y era beneficiario de concesiones y privilegios especiales que no recibía ningún otro inmigrante de ningún otro país de la Tierra, esto en parte gracias a las presiones ejercidas por la comunidad cubana en Miami.

El último en beneficiarse con la residencia automática para los cubanos sin necesidad de tener que hacer ningún trámite migratorio ante ninguna embajada norteamericana ni ante ningún consulado norteamericano, sin tener que estar haciendo fila en una larga lista de espera para que le toque su turno en unos diez años, sin necesidad de tener que llenar formularios, sin necesidad de tener que hacer ningún trámite burocrático, sin tener que aguantarse coraje alguno ante algún funcionario de mala cara, sin necesidad de tener que practicarse costosos exámenes médicos, sin necesidad de tener que estar recopilando mucha papelería y documentación oficial sobre su persona con copias notarizadas y apostilladas, como hoy se le pide a todos los demás aspirantes de los demás países del mundo, fue José Antonio Batista Silva. Después de él, todos los demás cubanos que quieran ingresar a territorio norteamericano sin cumplir con los mismos requisitos que se les pide a todos los demás inmigrantes del mundo, serán indocumentados indeseables. Tendrán una probadita de lo que han estado sufriendo muchos latinoamericanos a los cuales no se les dá ninguna esperanza ni opción para inmigrar legalmente a los USA. Y sufrirán la misma persecusión y cacería de la Border Patrol que se lleva a cabo en contra de los indocumentados. Serán, en efecto, indocumentados como los de cualquier otra nación. El cubano acaba de ser destronado de su posición privilegiada.

El problema para los cubanos que pretendan emigrar legalmente de Cuba hacia los Estados Unidos es que van a ser sujetos de las mismas dilaciones, de los mismos trámites burocráticos, de la misma soberbia y de la misma indiferencia que reciben ciudadanos de otros países del mundo que quieren inmigrar legalmente a los Estados Unidos, aunque tengan parientes en Miami. Y esto sí le va a doler hasta la médula del hueso a los cubanos que querían irse de Cuba a los Estados Unidos y que no cumplen ni siquiera con los requisitos mínimos que el Departamento de Estado norteamericano le exige a los ciudadanos de otros países del mundo. El trato diferenciado, el trato especial, el privilegio hasta cierto punto inmerecido, terminó, a menos de que Donald Trump como presidente dé una orden retroactiva y reinstale la política migratoria de “Pies secos, pies mojados”.

Trump como presidente puede, si se le pega la gana, reinstalar la política migratoria de "Pies secos, pies mojados". Pero de hacer tal cosa, entraría en conflicto inmediato sobre todo lo que le había prometido a sus millones de seguidores que votaron por él. El principal problema, al igual que hasta ese 12 de enero de 2017, es que cuando se le dá libre entrada a alguien a Estados Unidos sin checar primero en su país de origen si cumple con al menos una serie de requisitos mínimos, se le puede dar entrada a alguien que terminará convirtiéndose en una carga social para el gobierno de Estados Unidos, alguien cuya escolaridad tal vez no llega ni siquiera al grado más elemental (analfabetas funcionales), alguien que puede estar enfermo de alguna enfermedad contagiosa o que padezca cosas tales como VIH/SIDA, tuberculosis, lepra, en fin, hay una lista interminable. En el peor de los casos, se le puede estar dando entrada a un criminal extraordinariamente peligroso que va a terminar siendo un problema en cualquier lugar en donde se le ponga, inclusive en prisión, y si el gobierno cubano no está en disposición alguna de proporcionar al Departamento de Estado norteamericano la lista de antecedentes penales de aquellos cubanos que quieran dejar la isla de Cuba para irse a Estados Unidos, entonces no se sabrá la clase de alimaña social a la que se le ha dado entrada sino hasta que ya sea demasiado tarde y cometa alguna barbarie en Estados Unidos. Los controles consulares son precisamente para evitar este tipo de cosas.

De este modo, si Trump revierte la orden ejecutiva de Barack Obama, puede terminar admitiendo a su país sin revisión alguna individuos que no solo serán una carga social, sino incluso un peligro social, lo cual es una tunda a la intención anunciada por Trump de darle prioridad a la deportación de criminales indeseables. ¿Cómo puede prometer tal cosa, si al mismo tiempo que deporta a ciertos indeseables por una puerta, le dá entrada a otros indeseables por otra puerta? Tal vez el gobierno norteamericano que pretende dirigir Trump ya olvidó que fue precisamente durante el éxodo de Mariel que el Comandante Fidel Castro, mucho más listo que los norteamericanos, usó dicho éxodo para sacar de Cuba y enviar a Estados Unidos a lo más antisocial e incorregible que había en la isla, y no faltó quienes aseguraron que Castro aprovechó el éxodo de Mariel para vaciar las cárceles de Cuba cargándole el costo a los ingenuos norteamericanos que terminaron pagando con dólares y en muchos casos con sangre la política de puertas abiertas.

Por otro lado, Donald Trump debe en gran parte su triunfo electoral a los cubanos que residen en el estado de Florida. Desde un principio se supo que el estado de Florida era un estado que Trump necesariamente tenía que ganar, y fueron los cubanos quienes dándole la espalda a los demás latinos de Estados Unidos le permitieron obtener el triunfo en Florida. Si Donald Trump no dá marcha atrás en la eliminación de la política migratoria que daba preferencia a los cubanos sobre los demás habitantes del mundo, ello sería una soberana ingratitud e inclusive un insulto para la comunidad cubana de Miami.

Empeorando aún más las cosas para los cubanos a partir de ya, y respondiendo a una petición que le había sido formulada por los mismos cubanos que viven en Miami, Trump ha dejado ver sus intenciones de dar marcha atrás a la política de liberalización de Estados Unidos hacia Cuba si el gobierno cubano no accede a todas las demandas que Trump le quiera hacer. Si el gobierno cubano cede y se deja chantajear, entonces Trump podrá incluso imponer a su voluntad un gobierno títere acabando no solo con el modelo socialista de Cuba sino con la Cuba que los cubanos han conocido de toda la vida para terminar regresando a algo como lo que se tenía bajo el dictador Fulgencio Batista o inclusive algo todavía peor. Pero si el gobierno cubano se resiste a las amenazas de Trump, es probable que Trump endurezca el embargo estadounidense a Cuba. Pero algo así impactaría haría la vida imposible no tanto para el gobierno de Cuba como para los ciudadanos ordinarios. De este modo, los cubanos estarían ahorcados por partida doble, sin la posibilidad de poder emigrar legalmente a los Estados Unidos por ser algo prácticamente imposible de lograr tras la terminación de la política migratoria de "Pies secos, pies mojados", y por otro lado ahorcados por las restricciones impuestas por un embargo comercial endurecido por un tipo que prometió que ya como presidente lo endurecería. Y se reitera que esto último es algo que los mismos cubanos de Miami le insistieron mucho y le pidieron mucho a Donald Trump.

De haberse solidarizado los cubanos de Miami con los demás latinos del resto de Estados Unidos (y con lo cuales sienten que no tienen nada en común) en una oposición firme contra Donald Trump, haciéndole perder el estado de Florida, los cubanos que viven en Cuba no estarían enfrentando las duras disyuntivas que ahora están enfrentando por culpa de sus propios coterráneos que hoy viven en Miami. De este modo, el cubano-americano ha terminado convirtiéndose en el peor verdugo de los propios cubanos. Y si los cubanos de Miami creen que por el solo hecho de ser originarios de Cuba los asesores de Trump como Stephen Bannon les van a tener más consideraciones y les van a dar mejor trato que el que reciben los demás hispanos en Estados Unidos, es posible que van a tener enfrentar muy duro despertar pagando muy caro el no haberse solidarizado con los demás hispanos de Estados Unidos.

Usos inusuales de la orina

A muchos seguramente el olor de la orina les produce asco, y la consideran como un simple desperdicio del cuerpo cargado de toxinas que terminará parando en las aguas negras de la ciudad.

Sin embargo, y aunque cueste trabajo creerlo, la orina, sobre todo la orina recién expulsada, tiene importantes propiedades y beneficios que permiten darle usos poco convencionales que muchos ignoran, e inclusive puede salvarnos la vida en ciertas ocasiones críticas.

¿Quién no ha escuchado alguna historia de marineros o pasajeros de embarcaciones que naufragaron en alta mar, así como de gente perdida o atrapada en lugares y en regiones inhóspitas en donde no hay fuentes de agua dulce, y se mantuvieron vivos bebiendo su propia orina? Abundan los casos de aquellos que tras un terremoto quedaron atrapados bajo escombros por varios días, y pudieron sobrevivir bebiendo su propia orina. Ya sé que a muchos les causa asco la sola idea de beber orina, y al principio puede parecer la cosa más repugnante del mundo, pero no resulta tan malo si se toman en cuenta ciertas consideraciones. La primera es que, si vamos a tomar orina al estar perdidos o atrapados en algún lugar en donde no hay ninguna fuente de agua dulce, como le ocurre a los sobrevivientes que están entre los escombros de un terremoto, es mil veces preferible tomar la orina de uno mismo y no la orina de otro, aunque en ciertas situaciones no hay otra opción más que tomar la orina de uno mismo. La segunda consideración es que, si vamos a tomar nuestra propia orina, es importante hacerlo con la orina recién expulsada, la cual no es tan nociva como la orina que tiene varias horas de haber sido expulsada y empieza a emitir un olor desagradable. La única manera en la cual uno puede tomar su propia orina varias horas después de haberla expulsado es metiéndola de inmediato en un refrigerador para preservarla unos cuantos días, después de los cuales se tiene que desechar.

Una de los pocas aplicaciones que puede tener el “probar” la orina recién expulsada de otra persona (paladearla, pero sin beberla) consiste en usar su sabor para determinar, en el caso de las personas diabéticas, la cantidad de glucosa que contiene la orina. De hecho, esta era la manera en la cual mucho antes del descubrimiento de reactivos químicos y análisis de sangre con muestras de sangre obtenidas de la vena mediante una jeringa hipodérmica, los médicos de cientos de años atrás (posiblemente desde la época del Imperio Romano) podían diagnosticar a una persona como diabética y determinar incluso sus niveles de glucosa, porque entre más altos sean los niveles de glucosa en un diabético tanto mayor es la glucosa que estará presente en la orina recién expulsada. Esto significa que la diabetes se puede diagnosticar no solo mediante análisis de sangre sino que, en caso de emergencia, la puede detectar uno mismo a través de lo “dulce” que sepa la orina. En una persona no-diabética cuyo páncreas esté produciendo niveles adecuados de insulina, la orina no tiene ningún sabor dulce. Es posible que los primeros médicos de la antigüedad que descubrieron esto lo hicieron dándose cuenta de que la orina recién expulsada de ciertos  humanos (al igual que la orina de ciertos perros) atraía con mucho mayor intensidad a las moscas que la orina del resto de la población sana, esto en virtud del azúcar en la orina que funciona como una especie de imán a las moscas que son capaces de detectarla.

En la antigua Roma, existía una tradición entre los Galos que consistía en usar la orina para blanquear los dientes. Un poema famoso del poeta romano Cayo Valerio Catulo, criticando a un galo llamado Gellius Egnatius, dice: “Egnatius, debido a que el tiene dientes blancos, / sonríe todo el tiempo. Si eres demandado / en el tribunal, cuando el abogado señale lagrimas, / el sonrie: si estas de duelo en la pira / de piadosos hijos, la solitaria madre llorando, / el sonríe. Lo que sea, donde sea, / haga lo que haga, el sonríe: el se enferma, / ni cortes, yo diría, ni encantador. / Por tanto le recuerdo, de mi, buen Egnatius./ Si tu fueras un Sabino o Tiburtino / o un gordo Umbro, o un regordete Etrusco, / o un Lanuviano de oscuros dientes, o del norte de Po, / y yo mencionaré mi propia Veronesa también, / o quien sea limpie más religiosamente sus dientes, / Aun quiero que no sonrías todo el tiempo: / no hay nada mas tonto que sonreír tontamente. / Ahora que español: en el país de España / y lo que cada hombre mea, lo utiliza para el cepillado / sus dientes y rojas encías, cada mañana, / de modo que el hecho de que tus dientes están tan pulidos / solo muestra que estás más lleno de pis.”

Es importante recalcar que la orina de una persona sana no tiene mal sabor ni mal olor, ya que es sabor humano de la propia persona. Si la orina de una persona le provoca un mal sabor o tiene un mal olor, lo más probable es que tal persona está enferma y debe ir a atenderse a algún hospital o acudir con algún médico para consulta. De este modo, la orina puede servir como auxiliar de diagnóstico médico cuando las cosas no andan bien en nuestro cuerpo.

Las aplicaciones terapéuticas de la orina son parte de lo que se conoce como orinoterapia. No voy a entrar en detalle sobre ésto porque hay mucha literatura en Internet acerca de los aplicaciones útiles de la orinoterapia. Pero sí agregaré que, además del uso de nuestra propia orina para calmar nuestra sed cuando estamos perdidos o atrapados en algún lugar (tal vez un desierto), la orina tiene propiedades útiles para la limpieza de la ropa, y esto era usado ventajosamente por varias culturas antiguas antes del descubrimiento del jabón.

La razón del por qué la orina puede ser usada para la limpieza es que, horas (o días) después de haber sido expulsada hacia un contenedor, cuando empieza a oler mal, despide el olor característico del amoníaco que se produce como resultado de la descomposición de la urea. Y resulta que el amoníaco es uno de los más potentes limpiadores que se conocen, a grado tal que hay productos caseros de limpieza que se anuncian conteniendo amonio (no se preocupen mis lectores, esta amonia comercial no es obtenida de orina alguna sino de un proceso industrial usado para obtener la amonia en forma sintética a partir de sus elementos químicos esenciales).

El conocimiento de estas cosas nos demuestra que, en la Naturaleza, es posible reciclar todo de alguna manera, todo puede tener algún uso en ciertas épocas y bajo ciertas condiciones. Y hasta cosas como la orina que muchos consideran un simple desecho puede ser usada como medio de diagnóstico para detectar la diabetes cuando no hay forma alguna de encontrar un laboratorio cercano para efectuar los análsis de sangre de rigor, tratamientos de limpieza facial, o inclusive hasta para laver y limpiar la ropa en comunidades rurales pobres en donde no hay recursos para comprar detergentes caros.

Tainted presidency

Exactly one week from today, Donald Trump will take the oath of office to become the 45th president of the USA. Unlike the two previous ceremonies that marked each term of the Barack Obama administration, the podium will be held by a man who not only does not command any respect from nearly half of the American people, but who is now considered by many as an illegitimate president who owes his appointment thanks to the hacking that took place against prominent members of the Democratic Party, a conclusion now agreed upon by many.

It was bad enough to see a man known for his furious rantings and “tweets” claim to be the legitimate president elect of an entire nation despite losing the popular vote by nearly three million votes, but that’s the way the US democracy works (perhaps they should start calling it something else instead of a democracy). However, the nearly total agreement between US intel government agencies, including the FBI and the CIA, blaming Russian interference in the US presidential elections to the point at which such foreign meddling in US internal political affairs may have actually influenced the outcome in favor of Donald Trump, casts serious doubt over the validity of the triumph claimed by Donald Trump, to the point that some are already calling it a rigged election, rigged for the first time in US history by a foreign power using sophisticated malware in order to make just enough voters sway towards Trump giving him the presidency. This is deadly serious stuff built on a swell of evidence. And a growing number of Americans are becoming convinced that it is more than obvious that the target of cyber attacks was Hillary Clinton, the end purpose was to make her lose the US presidential election. Some as US Senator John McCain have gone so far as to call the Russian cyberintrusions an act of war that most certainly will go unpunished unless Barack Obama in the few days remaining in office wants to start a nuclear war with a country armed to the teeth with sophisticated nuclear missiles and capable of turning the USA into radioactive rubble.

Was the meddling of a foreign superpower inside the US presidential election enough to influence the outcome of the result and thus undermine forever and for good American democracy as we all used to know it? Perhaps. Would Donald Trump have lost without the help of a foreign country, a helping hand which by the way he asked for it in public with his own words? Perhaps. Unfortunately, these are things that cannot be quantified precisely. Putting some numbers to provide some solid answers would require a sophisticated Gallup-style statistical polling to determine how many voters changed their minds at the last minute because of all the materials leaked after previously being obtained as a result of the hacking, and even if this indeed happened it will not deprive Donald Trump of his claim to the presidency, however illegitimate it may be. At the very least, the results of the US presidential election held on November 2016 should have been declared null and void by the US Congress, with an interim US president appointed by Congress while new presidential elections are carried out once the facts of the hacking become better known to the general public. But this will not happen, the US democracy never had any provision to deal with these types of contingencies. That’s the way the US democracy works.

In the horse racetracks, if a winning horse is found to have been doped with performance enhancing drugs in order to make that horse win as was the case back in 2013 with the Godolphin doping scandal (one of the most powerful teams in horse racing was involved in a huge doping scandal involving 11 champion horses, whereby Team Godolphin, under the instructions of their head trainer, had being injected their horses with banned anabolic steroids for at least ten year), the horse is stripped of its crown, the championship title is given to the horse next in line, and the owner of the horse is headed to jail. But in the US presidential election, even if the election is found to have been rigged or if something illegal changed the outcome, the crooked winner still gets the US presidency in spite of the manner in which he gets it. And the power of the nuclear launch codes that goes along with it.

If indeed the 2016 United States election interference by Russia won Donald Trump his presidency, if he were a gentleman he would refuse to accept the presidency under these conditions and instead of showing up on January 20th for his inauguration he would ask Congress to appoint a temporary president until such time as new elections can be held in the USA. But if there is one thing that Donald Trump has proven over and over is that he is no gentleman, as evident by his disparaging treatment of women, Mexicans, the news media and all those who do not support him entirely.

On a previous entry in this blog entitled A question of legitimacy published here January 3 2017, the issue was raised on the fact that, due to the unusual circumstances surrounding the sabotage of the Democratic Party by a deliberate and well planned cyber attack hacking their computers to dig out and spread around the USA whatever dirt or suspicious unethical things that could be found thanks to the illegal hacking precisely on the few previous days before the election, thereby changing the outcome of the USA presidential election, there was a growing number of Americans, including some who voted for Donald Trump, convinced that Trump will actually become an illegitimate president.

Today, precisely on this Friday 13th, well respected Congressman and civil rights icon John Lewis for the first time in a headlines grabber pointed his finger directly at Donald Trump stating that he doesn't see Donald Trump as legitimate president, considering him in effect a phony, an usurper. The direct accusation laid out against Donald Trump by Congressman Lewis is clear: “I think the Russians participated in helping this man get elected. And they helped destroy the candidacy of Hillary Clinton”. And he is not the only one. There are many others, such as documentary filmmaker Michael Moore who since November 12th 2006 has also called Donald Trump an “illegitimate president” while making an unexpected appearance at Trump Tower ahead of a protest which took place in New York City. The list of those Americans who are becoming convinced that Donald Trump shouldn't take the oath of office because of the illegitimate way in which he "won" the election is growing by leaps and bounds. Even outside the USA, prominent politicians such as past Mexican president Vicente Fox have also stated without a doubt (November 16th) that Donald Trump is an illegitimate president. Vicent Fox should know what he is talking about; he was the first Mexican who coming out of an opposition party overthrew the long ruling PRI party that had held the presidency in Mexico for seven decades resorting mostly to a long history of fraud in the ballot boxes and control of the election procedures until the Mexicans got fed up and by exercising for the very first time true democracy in Mexico pulled the PRI out of the presidency. Commentator Paul Abrams of the Huffington Post has also made a roundup of several reasons of why Donald Trump is not only unfit to become the next president of the USA, he shouldn't be taking the oath of office to begin with, due to his illegitimacy.

An illegitimate president is no different from a crook who enters into a house by night and takes away what does not belong to him. He is no different from a weasel who commits fraud against naive people who were unaware of his intentions and methods, he is no different from a Latin American dictator who believes he has a right to seize power by whatever means because he is better than everybody else and is used to consider everybody else as pygmies and his obedient servants.

Even with an illegitimate presidency, if the usurper had been someone like Abraham Lincoln or Franklin Delano Roosevelt, at least he would have been tolerable considering all his efforts are directed towards the well being of his fellow citizens. But Donald Trump is quite the opposite, he is no Abraham Lincoln nor Franklin Delano Roosevelt, not by a long shot.

It should be a cause of grave concern even to those who voted for Donald Trump and still support him the recent claim that besides the hacking that took place against the Democrats, directed at derailing the hopes of Hillary Clinton to become president, there may have also been a sophisticated hacking directed at the Republicans and specifically against Trump himself. If the Russian cyber hackers were smart enough to penetrate the computers used by the Democrats and even Hillary Clinton herself, why should they not do exactly the same thing against Trump himself? Surely by his continuous use of Twitter, Trump has exposed himself by a huge amount of time to be spied upon by the master hackers of the planet, not to derail his presidential candidacy but to collect data on him which could be used as extortion material against him forcing him to comply or else all the dirty stuff they could now have in their hands would be used this time against him, threatening to expose him in a series of major scandals if President Trump refuses to comply with the wishes or commands of those who possess incriminating or scandalous materials against him.

Recently, the chiefs of America’s intelligence agencies presented President Obama and President-elect Donald Trump with a summary of unsubstantiated reports that Russia had collected compromising and salacious personal information about Mr. Trump. The two-page summary, first reported by CNN, was presented as an appendix to the intelligence agencies’ report on Russian hacking efforts during the election, the officials said. Intelligence agencies considered it so potentially explosive that they decided Mr. Obama, Mr. Trump and congressional leaders needed to be told about it and informed that the agencies were actively investigating it. Intelligence officials were concerned that the information would leak before they informed Mr. Trump of its existence, said the officials, who spoke on the condition of anonymity because they were not authorized to speak about it publicly. The author of the memos is thought to be Christopher Steele, a former British intelligence officer with MI-6, who once served in Moscow. After Mr. Steele retired in 2009, he founded a private firm called Orbis Business Intelligence in London. Former C.I.A. officials described him as an expert on Russia who is well respected in the spy world. All this has been dismissed, but no one in the intelligence communities is saying that besides Hillary Clinton and her team, Donald Trump and his team was not also a target of the same clever hackers.

Just recently, Miss Hungary, model Kata Sarka, 30, claims married Donald Trump invited her to his Moscow hotel suite after the 2013 Miss Universe pageant where a “dodgy dossier” claims he frolicked with prostitutes. She also claims that the two met after the Miss Universe pageant in the Russian capital, that she kept Trump’s business card and showed it to a Hungarian tabloid, and that during Trump’s stay it is alleged that he watched as prostitutes urinated on one another while on the bed in a ‘golden showers’ routine, all this as part of a dossier alleging that Trump’s lewd sexual behaviour in Russia was recorded by the Kremlin’s intelligence agencies and held as ‘kompromat’, or damaging information which it has used or will be used to blackmail Trump when all that information on him becomes handy. If these and even more dirty things happened in the personal private life of Donald Trump, and through his constant use of a smartphone or laptop computer he was dumb enough to share this info with some of his friends, then it is almost a sure bet that the hackers have all the details. Which would mean that the same hackers who cost Hillary Clinton her presidency may also have Trump himself by the throat, which means that the Russian government could have the president of the USA at its mercy, ready to do their biding or else! And on top of this, if Donald Trump is considered by many to be an illegitimate president, this makes it even more disgusting that the highest man in office may be the subject of one extortion after another based upon facts of his private life which would make the worldwide headlines.

In spite of what Donald Trump has stated against Mexicans considering them as rapists, drug traffickers and criminals, Mexico has many distinguished world class intellectuals and academicians. Well known Mexican historian Enrique Krauze, quoting from a famous phrase used after Hitler's invasion of Poland that exhibited the futility of the failed policies of appeasement (especially as was the case with British Prime Minister Neville Chamberlain and the Munich agreement) has stated that “Tyrants are not be appeased, they must be confronted directly”. And well known Mexican analyst and commentator Enrique Sarmiento has concluded, after analyzing and studying the things that went on in the first news conference of Donald Trump held on Wednesday January 11 2017, that Donald Trump is mentally unstable, and has stated so in his column entitled “Jaque Mate” under the article “Precio administrado”. If these Mexican intellectuals are right even just a little bit, Americans should have cause for concern for they will be giving next Friday January 20th the nuclear codes to a deranged man who will have at his fingertips the awesome power to unleash World War Three, which may very well be the last world war that will be waged by mankind before it falters into oblivion.

Obama’s retribution

Soon, very soon, it will be time for Donald Trump to make a decision as President with which he will definitely put a very large segment of the US population against him, or put many of his own followers against him. It is a decision involving the Dreamers. But first, let’s see how President Barack Obama can come to the rescue by saving Trump’s neck from a looming public relations nightmare involving this thorny issue of the Dreamers.

The Dreamers, as many of us already know, are those students who were not born in the USA and who are undocumented aliens with most of them brought to the USA by their parents when they were too young to even remember, most of whom will be subject to immediate deportation if Donald Trump sticks to his promise of deporting every single undocumented alien who remains in the country without complying with the usual immigration requirements that those who enter legally into the USA must obey. Yes, the Dreamers are in the USA knowing full well that their parents broke the law and that they themselves are also breaking the law.

Many of the Dreamers are high school students, some with perfect grade point averages, but there are also those Dreamers enrolled at colleges and universities with some of them pursuing their Masters or PhD degrees at Ivy League academies of higher learning. The graduates who appear in the photo above are all Dreamers, and they are also all UCLA graduates. This is the kind of quality immigrant we are talking about. Clearly these are the talented people no other country with a little bit of common sense would unload, especially not the USA of yesteryear that allowed millions of impoverished immigrants from all over the world to establish themselves and contribute with their individual skills and talents to the growth of the USA, to the point that even Nazi scientists were flown to North America under Operation Paperclip. It has been said over and over that “Europe’s poor made America rich”. But that was the USA of yesteryear, long before Donald Trump became the winner of the 2016 presidential elections, a new USA which the same Bulgarian seer Baba Vanga who before she died in 1996 predicted that the 44th president of the USA would be a Black president also predicted that the USA would enter into an irrevocable and irreversible stage of collapse.

Even before Barack Obama became President of the USA, there was an attempt in the US Congress to help these brilliant young undocumented students stay in the USA as legal residents, helping them overcome their limbo status and helping them achieve the so-called American dream. It was the DREAM Act, which stands for Development, Relief, and Education for Alien Minor, an American legislative proposal for a multi-phase process for undocumented immigrants in the United States that would first grant conditional residency and upon meeting further qualifications, permanent residency. This bill was first introduced in the Senate on August 1, 2001 by Dick Durbin and Orrin Hatch, and has since been reintroduced several times. However, this bill has failed to pass, mostly due to opposition from Republican legislators. The requirements for the granting of a conditional resident status to the Dreamers appear to be reasonable enough: each applicant must have proof that they entered United States before the age of 16 and must have continuously lived in the country for at least 5 years, he/she must have graduated from a United States high school or obtained a GED, each applicant must demonstrate that he/she has good moral character, and is required to pass criminal background checks and reviews. After having obtained and held conditional resident status, permanent residency may be granted if for a period of six years the beneficiary of the DREAM Act has attended an institution of higher learning or served in the United States military for at least 2 years and if discharged, have received an honorable discharge, has passed another series of background checks and has continued to demonstrate good moral character. Indeed, any newcomer at Ellis Island who could meet these requirement would have received not just permanent US residency but would have been granted also full US citizenship. This is precisely how the USA came into being.

As mentioned, there is no DREAM Act at the present time since it has never been passed by the US Congress, mostly due to opposition by Republicans.

Lacking a protective measure such as the DREAM Act, many young men have a grim outlook on life, waiting to be kicked out of the USA at any moment regardless of whether he is studying to become a molecular biologist at UCLA or to become an architect at Stanford.

When Barack Obama came into office, after being unable to sway Congress to approve something like the DREAM Act, acting on his own he passed by an executive presidential order the Deferred Action for Childhood Arrivals (better known as DACA) on 15 June 2012, a date chosen as the 30th anniversary of Plyler v. Doe, a Supreme Court decision barring public schools from charging undocumented immigrant children tuition. As expected, Republican Party leaders denounced the program as an abuse of executive power. Going even further, President Obama signed into law another executive presidential order called Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA), angering Republicans in Congress even more.

DACA and DAPA have provided temporary relief from what would otherwise have been imminent deportation. However, DACA and DAPA are not supposed to last forever, both have a limited time period that expires when President Obama leaves office, unless renewed by his successor, i.e. Donald Trump, or unless President Obama issues a Presidential pardon. There is a wide list of people who have been granted pardon or clemency by US presidents. Although many believe that a presidential pardon is something which should be granted on a case-by-case basis and not wholesale, there is a legal precedent on how this can be done, when President Jimmy Carter issued on 15 June 2012 a presidential pardon to all the draft dodgers who refused to serve in the US Army during the Vietnam war era. This pardon, although controversial and denounced as unfair by all those servicemen who did serve their country and by the relatives of those servicemen who died in Vietnam, was never challenged in court, and thus set a legal precedent.

In just ten days, Donald Trump is set to be sworn into office as the 45th President of the USA. And one of the first things he will have on his desk is what to do about all those Dreamers. There is no expiration date per se for all the DACA program, it is up to each current beneficiary to renew his DACA permit which is only valid for two years unless it is renewed. All DACA forms have an expiration date and the protection afforded by DACA is lost unless DACA is renewed by each Dreamer every two years. However, with the firm promise made by Donald Trump to all his loyal followers on deporting every single undocumented alien now in the USA, going out of the country so fast your head will spin, which necessarily implies either killing DACA or breaking his campaign promise, USCIS (United States Citizenship and Immigration Services,  a component of the United States Department of Homeland Security under orders from Donald Trump all it has to do is to simply stop accepting and processing DACA forms regardless of an expiration date on them. With a two years time limit on each DACA form, if not renewed, every single DACA beneficiary will inevitably become subject to deportation. all of them. That is, unless President Obama issues issues issues a presidential pardon to all of them.

Even though he may not say it in public, Donald Trump would just love for Barack Obama to issue a presidential pardon to all those Dreamers who are desperately clinging to any glimmer of hope they can find before Trump becomes President. But President Obama has already made it clear he will not issue a presidential pardon to the Dreamers. The White House argues that there isn’t a viable road to take to pardon the Dreamers. White House officials have signaled that only Congress really has the ability to pardon those individuals and that the president does not hold the constitutional powers to grant that kind of immunity. Beyond the broad rejection of Obama’s power to pardon those Dreamers there are more specific questions about its legality, including whether a president can pardon an individual for crimes for which they haven’t been charged and whether a pardon would actually protect them from deportation while they seek legal status in the country. Nevertheless, President Obama as an act of defiance could still issue a presidential pardon to all the Dreamers, just before he leaves office, and let the incoming Trump administration challenge and try to overturn such pardon.

The truth of the matter is that President Obama is in no mood to make things easier for Trump regarding the issue of the Dreamers. Trump would just love seeing Obama issue a presidential pardon to all the Dreamers, because in doing so he would wash his hands like Pontious Pilate putting all the blame upon President Obama for being unable to overturn something which may be granting amnesty to Dreamers now enrolled at colleges and universities with some of them pursuing their Masters or PhD. degrees at Ivy League academies of higher learning. Trump would simply throw the hot potato to the Republican controlled Congress, where the unpopular decision to deport thousands of bright young people would stall most attempts to overturn for the first time in US history a presidential pardon.

Anticipating that Barack Obama will refuse to give a definite solution to the anguish of all the Dreamers now subject to deportation by granting them a presidential pardon, and in spite of appointing such a fierce anti-immigrants bulldog as Prosecutor General of the United States, in one of his most spectacular recantings yet on his previous campaign promisesTrump has stated that he will simply continue with the same policies implemented by Barack Obama regarding the deportation of undocumented aliens, not just by lowering the number of those who will be deported under his orders from an estimated 11 million to something between 2 and maybe up to 3 million undocumented immigrants (an announcement that represents a major disappointment to groups such as the the the the the Federation for American Immigration Reform) focusing primarily on those with criminal records, which is no different from the deportation policies that have been used all along in the Obama administration. This would be his first big broken promise and a slap in the face to those followers who believed Trump was serious about deporting all undocumented aliens so fast that heads would be spinning. The Dreamers certainly do not have any criminal records since otherwise they would be inelegible to apply for relief under the DACA program, quite the contrary, they are law abiding people who in spite of being in the USA illegaly do not break any laws whatsoever. Thus, under the modified Trump deportation plan of focusing strictly on those aliens with criminal records, with an emphasis that amounts to the granting of amnesty (Republicans have fiercely opposed granting any kind of amnesty to undocumented aliens) all of the Dreamers would be spared from any action against them, and unless US Immigration is ordered by President Trump to stop renewing all DACA forms, without being legal US residents the Dreamers would not  be better off with Donald Trump but they would not be any worse either. As to how long Trump can sustain this charade that is an open question. But the main point is that he appears to have accepted that Barack Obama will not resolve this issue for him and will leave it up to Trump to face irate Republicans and ardent Trump followers who will feel betrayed.

No, Barack Obama will not make things any easier for Donald Trump regarding the issue of Dreamers. He will not issue a presidential pardon to them. And by so doing, he will force Donald Trump to take a very hard political decision on his own, and force him to carry on his shoulders for the rest of his life the consequences of something which could even end up costing Trump his reelection in 2020. And this is precisely Obama’s retribution. He will throw a very hot potato directly at the desk of Donald Trump, and let him anger a wide segment of the American public regardless of the decision he takes. And all this will begin to unravel (it has to unravel!) in just ten days, when Donald Trump takes office. No doubt Barack Obama will simply stand on the sidelines enjoying himself while he watches from afar how Donald Trump will be forced to open up a can of worms.
